Councilmember Hendriksen stated that his problem with this is the last sentence of <br />Subdivision 3, which reads: The Building Official shall not issue the permit if the <br />proposed location will not allow for orderly future subdivision of the parcel. We fought a <br />big battle on that. Now we are giving our Building Official power to say how they <br />should build on their lot. <br /> <br />Mayor Gamec inquired what the City's liability is for a building being placed wrong on a <br />lot. <br /> <br />Ms. Frolik stated that there is also a clause in Chapter 9 that puts people on notice that <br />they should locate their buildings on a lot that would allow future development. <br /> <br />Mayor Gamec felt that people should be made aware of this. Maybe it should be worded <br />that the Building Official should advise people of where to place their building. He <br />would hate to see neglect on the City's part. <br /> <br />Councilmember Zimmerman commented that there are still setbacks that a person has to <br />conform to. <br /> <br />Ms. Frolik noted that but added that if it is a large lot, they would be able to put it <br />anywhere on the lot and that would disallow any other development. <br /> <br />City Attorney Goodrich interjected that the language could read that the Building Official <br />shall advise the landowner if the proposed location will not allow for orderly future <br />subdivision of the parcel. <br /> <br />Councilmember Hendriksen asked if the City would incur more liability if we advise. <br /> <br />Mr. Goodrich responded that the City would incur less liability if we advise correctly. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Zimmerman to <br />accept the alternative wording by Attorney Goodrich which states that the Building <br />Official shall advise the landowner if the proposed location will not allow for orderly <br />future subdivision of the parcel. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman <br />and Anderson. Voting No: None. <br /> <br />Councilmember Anderson expressed concern about the height of pool fences - she felt <br />they should be taller. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hendriksen to <br />adopt Ordinance #99-05 amending Sections 9.02 and 9.22.01 of the Ramsey City Code <br />regarding accessory buildings. <br /> <br />A roll call vote was performed by the Deputy City Clerk. <br /> <br />City Council/April 27, 1999 <br /> Page 17 of 25 <br /> <br /> <br />
