Motion by Councilmember Hendriksen and seconded by Councilmember Zimmerman to <br />direct staff to negotiate a development agreement with all parties involved (Direct <br />Enclosures). <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman <br />and Anderson. Voting No: None. <br /> <br />Case #10: Minnesota Magic Midway Inc. <br /> <br />City Administrator Norman stated that Minnesota Magic Midway presented a carnival <br />application to the City. The land they are requesting for the carnival is owned by R.F. <br />Development, LLC in Elk River, and Chief Manager Richard Foster, is not authorizing <br />any land owned by R.F. Development for operation of a carnival. Without the <br />permission of the landowner, the carnival cannot operate at the requested sites. Thus, <br />staff is requesting Council deny the request based on that fact. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Zimmerman to <br />deny the carnival application request by Minnesota Magic Midway Inc., based on the <br />letter, dated May 18, 1999, by R.F. Development denying authorization to use their <br />private property for operation of a carnival. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Henddksen, Zimmerman <br />and Anderson. Voting No: None. <br /> <br />Case #11: <br /> <br />Introduce Ordinance to Add Section 7.14 "Carnivals" to Chapter 7 of <br />the City Code <br /> <br />Administrative Services Manager Pruitt Hottinger stated that the City of Ramsey does not <br />currently regulate carnivals. Staff only verifies the carnival has obtained authorization to <br />operate on the land. In order to provide protection of the public's health, safety and <br />welfare, a draft ordinance regulating carnivals was presented for review at the May 18, <br />1999 Council work session. She presented the ordinance for introduction, noting that <br />staff will schedule a public hearing for the second reading. <br /> <br />Councilmember Hendriksen, to the City Attorney, inquired if by virtue of licensing or <br />inspecting, are we creating a liability for the City. <br /> <br />Attorney Goodrich replied yes, if done improperly, it would be a liability. <br /> <br />Ms. Pruitt Hottinger stated that the Cities of Maple Grove, Andover, Blaine and Anoka <br />have all taken language from the State Statutes. <br /> <br />A concern was expressed that carnival operators are under aged kids and they should be <br />adults.
