Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 8:01 <br />p.m. <br /> <br />Chairperson Nixt noted the applicant is allowed to appeal the decision of the Board of <br />Adjustment of denial for the variance on the cul-de-sac length. He suggested the Commission <br />provide City Council with their thoughts on the development as a whole in the event that the <br />Council overrides the determination of the Board of Appeals regarding the variance. <br /> <br />Commissioner Brauer commented the first pertinent question is regarding how much of this land <br />is actually developable. This relates to whether this development as it is platted is in effect using <br />all the developable land, which is not in the spirit of the cluster ordinance as it is drafted. <br /> <br />Associate Planner Dalnes replied the platted lots and streets, including the septic outlot, is <br />basically the entirety of the developable area. If a future re-subdivision is done it would be <br />limited to the number of lots that would be allowed in the abandoned septic system outlot. <br /> <br />Commissioner Brauer requested clarification that the plat depicts the site essentially at maximum <br />build-out. <br /> <br />City Engineer Jankowski noted Mr. Maloney had indicated approximately three additional lots <br />could be located in the septic outlot. <br /> <br />Chairperson Nixt noted the Staff Review Letter is generally supportive of the development other <br />than the cul-de-sac length. <br /> <br />Associate Planner Dalnes replied that is generally correct. There are still some concerns <br />regarding the single access, but code does not speak to this issue. <br /> <br />Chairperson Nixt indicated his impression is that in relation to density, lot size and width, <br />provision for future connectivity, density transitioning, compliance with the wetland buffer <br />ordinance, drainage, grading, etc., the application in general complies with the cluster ordinance <br />as it exists, as well as other ordinances that would be applicable to this development. <br /> <br />City Engineer Jankowski advised there are a couple of management issues that were requested <br />that have not yet been complied with. If the water utility system will not be utilized at the <br />present time with a dry pipe put in the ground, there will need to be a management plan to ensure <br />it is able to function five to ten years in the future. <br /> <br />Commissioner Trites Rolle noted it appears that the applicant has made an attempt to address <br />some of the issues outlined in the StaffReview Letter with the letter dated today. <br /> <br />Planning Commission/May 4, 2006 <br /> Page 3 of 15 <br /> <br /> <br />
