The Amendment also would
prohibit owners of non-homestead real property greater than one acre in size fi.om petitioning
against such public improvement projects.

State statute directs how the City Charter may be amended. ' One of the methods is that being
proposed by this Amendment. Upon recommendation of an ordinance by the Charter Commission,
the City Council shall hold a public hearing on the ordinance. If the Council adopts the ordinance
UNANIMOUSLY, it then is published as other City Ordinances. The ordinance is not effective
until 90 days after passage and publication. Within 60 days after passage and publication, a petition
requesting a referendum on the ordinance may be filed with the City Clerk. Such petition needs to
be signed by two percent (2%) of the total number of votes east in the City at the last state election
or 2000 whichever is less. In the event a petition is fried, the ordinance will not become effective
until it is approved by the voters. There is other detail or an election which process will be further
explained if a petition is received.

Enclosure:

Proposed Ordinance

Recommendation:

Consider adoption of enclosed Charter amendment Ordinance

Council Action:

Motion to adopt Ordinance 06-
8.4.4 of the City Charter

, which is an Ordinance amending Sections 8.4.2, 8.4.3 and

Reviewed by:

City A~omey
CityAdmirdstrator
City Clerk

CC: 06/13/06

-191-
