We feel the best way to do the assessment <br /> is the entire tract; however, under this language, they could petition and kill this process. <br /> <br /> Attorney Goodrich stated that whatever language is talked about, we must make sure it's <br /> constitutional. <br /> <br /> Mr. Norman cautioned that the City could lose some good projects because of this. <br /> <br />· Chairperson Vogt explained the process for Charter amendments. <br /> <br /> Commissioner Fischer suggested that this language is something we would want to have ready in <br /> a very short period of time. <br /> <br /> Mr. Goodrich sated that we thought about amending it by ordinance - that's one of the ways to <br /> amend the Charter. In that instance, the Charter Commission would recommend the ordinance to <br /> the City Council. The City Council would have a public hearing and if the City Council passed <br /> the ordinance unanimously, they would adopt the amendments, and 90 days after its publication, <br /> the amendment would be effective. <br /> <br /> Commissioner Ebel inquired if any developers have sated that they would be pulling out of <br /> Ramsey because of this. <br /> <br />Mr. Norman replied no, but we have shared this discussion with them. We have heard about one <br />waiting for another to develop so the first would have to pay all the fees. Because of this Charter <br />meeting being scheduled, staff decided to discuss this now too. <br /> <br />Mr. Goodrich stated staff would work on language right away and that the Charter Commission <br />should meet again very soon. <br /> <br /> Commissioner Deemer mentioned making some technical corrections. <br /> <br />Chairperson Vogt suggested moving forward with this and maybe Commissioner Deemer could <br />talk with Attorney Goodrich about the technical corrections. <br /> <br />Commissioner LaMere sated that Chapter 429 is about assessments based on benefits and <br />inquired if Chapter 444 is not based on benefit. <br /> <br />Attorney Goodrich responded that Chapter 444 is where we can set up an ordinance for hook up <br />fees and for storm water - that's a different process than showing benefit. <br /> <br />Commissioner LaMere sated that sewer and water are not the issue. Are there any other <br />specified statutes on transportation funding and costs. <br /> <br />Attorney Goodrich replied no - there is lots of discussion on transportation impact fees - they <br />are illegal in Minnesota. <br /> <br />Charter Commission - April 27, 2006 <br /> Page 3 of 6 <br /> -21- <br /> <br /> <br />
