Motion by Councilmember Cook, seconded by Councilmember Olson, to approve Cingular's <br />request for a Conditional Use Permit based on Findings of Fact #0765 and adopt Resolution #06- <br />05-153 declaring terms of same. <br /> <br />Motion carded. Voting No: None. <br /> <br />Councilmember Elvig left the Council dais. <br /> <br />Case #8: <br /> <br />Request for Approval of a Registered Land Survey for Outlot L, Ramsey <br />Town Center Addition; Case of Ramsey Town Center, LLC <br /> <br />Con~nunity Development Director Trudgeon explained under the Ramsey Town Center Master <br />Development Agreement and the Ist Amendment to the Master Development Agreement, <br />Ramsey Town Center LLC is required to convey land to the City of Ramsey for the future <br />construction of a second municipal parking ramp. The second ramp was identified to be located <br />within the property currently known as Outlot L, Ramsey Town Center Addition. The only <br />avenue to convey land to the City is through a Registered Land Survey (RLS). Mr. Trudgeon <br />stated the RLS shows two parcels, Tract A and Tract B. The City will be receiving Tract B, <br />which is approximately 1.99 acres in size, for the future parking ramp. The proposed Tract B is <br />consistent with the original size and location for the second parking ramp. The City is working <br />with Ramsey Town Center, LLC to secure proper access to Tract B from public streets in a <br />recordable form. <br /> <br />City Attomey Goodrich advised the motion should state that the RLS is subject to legally <br />recordable access to Tract B being provided to the City, and the size of Tract B as determined by <br />the City Attorney. <br /> <br />Motion by Councilmember Jeffrey, seconded by Councilmember Cook, to adopt Resolution #06- <br />05-154 approving a Registered Land Survey for Outlot L, Ramsey Town Center Addition, <br />subject to legally recordable access to Tract B being provided to the City, and the size of Tract B <br />· as determined by the City Attorney. <br /> <br />Further discussion: Mayor Gamec inquired if RTC will be building the ramp. City Attorney <br />Goodrich responded in the negative. They are trying to get the land issues in order; the City still <br />has title to Outlot L. <br /> <br />Motion carded.
