Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, for the City <br />to proceed with the extension of Sunwood Drive. <br /> <br />Further discussion: Councilmember Connolly stated that she was voting no because she had <br />concerns with screening of the existing housing and trails that will enter the neighborhoods. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, and <br />Anderson. Voting No: Councilmember Connolly. <br /> <br />Case #5: <br /> <br />Request for Approval of Metes and Bounds Subdivision; Case of Ronald <br />Danner <br /> <br />Zoning Administrator Frolik stated that Ron Danner resides at 17400 Erkium Street Northwest. <br />His property is 27 acres in size and he is requesting approval of metes and bounds subdivision to <br />separate his homestead and four acres of the land from the remainder of his property. She <br />explained that Mr. Danner desires to sell his home with four acres of land and retain the <br />remaining 23 acres for possible future development. The homestead parcel is subject to the <br />regulations of the Scenic River Overlay District, for which the minimum lot size is four acres for <br />riparian lots. The property is also in the Rural Transition area for which there is a four units in <br />40 acres density restriction. The subdivision proposed complies with the four in 40 density <br />restriction and the four acre minimum lot size. <br /> <br />Jill Purseller, Gries & Lenhardt, P.L.L.P., stated that her firm was representing Ronald and <br />Jacqueline Danner. She explained that their intent is to sell four acres of the current 27 acres <br />which has a homestead on it. The property cannot be subdivided by a minor plat so Mr. Danner <br />is requesting to proceed by a metes and bounds subdivision. Ms. Purseller stated that the <br />hardship that the Danner's would be faced with if Council does not approve their request is that <br />Mr. Danner owns his own business in the City of Ramsey and he is taking early retirement and <br />would like to move to the Mille Lacs Lake area, but keep the remaining acres for their son and <br />daughter so they may some day build their own homes. If the Danners are forced to sell their <br />entire parcel, all 27 acres, in order to sell their house, their son and daughter will lose the <br />opportunity in the future to build their home on this family land. Moreover, in their opinion, it <br />would be economically wasteful to require the Danners to sell all 27 acres in order to sell their <br />house. It is not likely that they would be able to obtain full value for their property unless they <br />are able to split off their house and four acres. <br /> <br />Councilmember Hendriksen stated that in 1983, when the variance was granted for the home to <br />be built, it was stated that no future subdivision of the property would be allowed without a <br />public road. <br /> <br />Ms. Purseller stated that the intent in 1983 was to prevent any future building or development <br />and the Danners are not requesting to build on the property, only to retain the 23 acres. <br /> <br />City Council/August 10, 1999 <br /> Page 10 of 16 <br /> <br /> <br />
