Public Hearine <br /> <br />Mayor Gamec called the public hearing to order at 7:25. <br /> <br />Presentation <br /> <br />Community Development Director Sherman stated that Rick and Barbara Burnham are in the <br />process of building a new home in Northfork Oaks 2"a Addition. They own Lots 1 and 2 of <br />Block 1 and desire to center their home on the property. In doing so, the structure will extend <br />over the common property line between the two lots. There is a standard 1 O-foot wide drainage <br />and utility easement on the common property line between the two lots. The City should not <br />issue building permits over drainage and utility easements and a vacation of the easement is <br />necessary. There are not utilities existing in the easement to be vacated. The City Engineer <br />indicated that the vacation of the easement will not impact the drainage plan for the area. The <br />Burnham's did a lot combination at the County, which does not require City approval. <br /> <br />Citizen Input <br /> <br />Rick and Barbara Burnham stated that they would like to move forward as soon as possible to <br />begin construction before the first snowfall. Mr. Burnham stated that he was informed that there <br />may be some legal issues that could hold up the project. <br /> <br />Community Development Director Sherman stated that he was referring to the two readings of <br />the ordinance which would delay the start date for 30 days. <br /> <br />Motion to by Councilmember Hendriksen, seconded by Councilmember Connolly, to close the <br />public hearing. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Connolly, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />The public hearing closed at 7:27 p.m. <br /> <br />Council Business <br /> <br />Mayor Gamec called the regular portion of the City Council meeting back to order at 7:27 p.m. <br /> <br />Mayor Gamec questioned if there was no objection to the project if they could speed up the <br />process. <br /> <br />City Attorney Goodrich explained that the ordinance has to be adopted and then there is a 30 day <br />waiting period requirement to allow residents time to protest a project before the ordinance <br />becomes effective. <br /> <br />City Council/September 14, 1999 <br /> Page 5 of 23 <br /> <br /> <br />
