neighbor does not own or lease the truck, but that he is under contract with a company and could <br />lose his job at anytime. Then the neighborhood would be stuck looking at a large garage. He <br />requested the Council assist with the situation suggesting that they require him to store the <br />vehicle at an off-sight storage. Mr. Green expressed that it is not right that he has been given <br />special privileges by the City when several neighbors are being impacted by the problem. <br /> <br />Mayor Gamec inquired if the construction of the garage requires a conditional use permit. <br /> <br />Community Development Director Sherman explained that if the garage met all of the building <br />requirements, a building permit would be issued, otherwise if the project would require any <br />variances than it would require a conditional use permit. <br /> <br />Councihnember Zimmerman questioned if the truck is parked on the driveway. <br /> <br />Mr. Green replied yes, and explained that the truck is parked without chalk under the wheels, <br />which he noted is a requirement of OSHA, and that it is parked on a steep hill. <br /> <br />Mayor Gamec stated that the issue is something that the Council should look at and consider <br />stricter enforcement. <br /> <br />Councihnember Hendriksen replied that the position of the Council was that Staff would not <br />proactively go out and find things in violation, but review items on a complaint basis. <br /> <br />Mr. Green stated that the first complaint was made in May and the truck still sits in the driveway. <br /> <br />Councilmember Hendriksen requested that the item be added to the end of the agenda to discuss <br />what decisions have been made by the City regarding the issue. <br /> <br />Motion by Cotmcilmember Connolly, seconded by Councilmember Zimmerman, to add the issue <br />as Case #15 to the agenda. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Connolly, Zimmerman, <br />Anderson, and Hendriksen. Voting No: None. Absent: None. <br /> <br />APPROVE AGENDA <br /> <br />Councilmember Zimmerman requested that Case # 2 be moved to the top of the agenda. <br /> <br />City Attorney Goodrich requested that Case #16 Sale of Vacant House to ACCAP, and Case #17 <br />Approve Appraisal for the Fire Station Site be added to the agenda. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to approve <br />the agenda as amended. <br /> <br />City Council/September 28, 1999 <br /> Page 3 of 30 <br /> <br /> <br />
