Councilmember Hendriksen stated that one of his concerns is that when they are dealing with an <br />urban area that has been recently platted the cost is relatively low, however when there are larger <br />lots in the rural area the cost is higher and the need is not beneficial. They are trying to fill the <br />need in both areas of the City. <br /> <br />4) Consider Right-of-Way Ordinance <br /> <br />Councilmember Zimmerman stated that the Public Works Committee reviewed a case <br />establishing a right-of-way ordinance, which would govern the usage of City right-of-way by <br />utilities and organizations wishing to locate their equipment and structures. The ordinance is <br />modeled after a League of Municipalities model ordinance. The Committee had the following <br />concerns, which they directed Staff to further investigate: <br /> <br />1. Does the ordinance adequately allow for a surety to cause the removal of equipment and <br /> utilities, if necessary? <br />2. How does this ordinance compare with the ordinance supplied from the Cable Commission? <br />3. Report on a franchise ordinance to charge for the use of the right-of-way. <br /> <br />Mayor Gamec inquired if there was a way to adopt the ordinance and then revise it as needed. <br /> <br />Councilmember Zimmerman replied that Staff is gathering information and will be brought back <br />next month. <br /> <br />Councilmember Hendriksen questioned if Staff determined if it was the same ordinance that was <br />submitted by the Cable Commission. <br /> <br />City Attorney Goodrich replied that the ordinance was 98 percent the same as the ordinance that <br />was adopted by the City of Anoka and reviewed by the Cable Commission Attorney. <br /> <br />Councilmember Hendriksen requested that the City Attorney put the ordinance into a final draft. <br /> <br />5) Report from Meeting with Bill Rademacher and Discussion of Barium Street <br /> Drainage <br /> <br />Councilmember Zimmerman stated that Staff reported that Bill Rademacher was willing to both <br />sell or donate the eastern portions of Outlot A to the City, depending on whether the City would <br />support an access from T.H. #47 into Outlot A and Bill's Superette. Staff pointed out that <br />MnDOT does not possess the right-of-access to Outlot A, but also that an access at that location <br />may be inconsistent with the T.H. #47 Corridor Plan. The Committee recommended that Staff <br />provide a review of the corridor study to determine whether an access exception may be possible <br />in the location desired by Rademacher.
