PIN <br />FEE OWNER <br />28- 32 -25 -13 -0001 <br />B.M.A. Associates, a <br />Minnesota Partnership <br />WHEREAS, the City has authority to acquire the Subject Property for the Public <br />411 Improvement Project by eminent domain pursuant to Minn. Stat. Chapter 117; and <br />• <br />WHEREAS, the City has the right to acquire the Subject Property prior to the filing of <br />an award by the Court appointed commissioners, pursuant to Minn. Stat. §117.001 and §117.042; <br />and <br />WHEREAS, the City finds and declares that it is in the public interest to acquire title to <br />and possession of the Subject Property prior to the filing of an award by the Court Appointed <br />Commissioners; and <br />WHEREAS, the property owner of the Subject Property and the Anoka County PIN for <br />the said property have been identified by the City as follows: <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That in order to carry out the purposes and objectives described above it is necessary <br />to acquire the Subject Property. <br />2. That the acquisition of the Subject Property by exercise of eminent domain in the <br />manner provided by Minnesota Statute Chapter 117 serves a public interest and is <br />deemed to be necessary. <br />3. That the City deems it necessary for the reasons set forth above to proceed without <br />delay under Minn. Stat. §117.042 to pay to the owners or into court a sum of money <br />to serve as compensation to the owners of the Subject Property, which amount shall <br />be equal to Petitioner's approved appraisal of value as determined by the City. <br />4. That the City Administrator is hereby directed to acquire the Subject Property as <br />described above in accordance with Minnesota Statutes. The City Administrator is <br />authorized to negotiate and represent the City of Ramsey in all proceedings. <br />5. That if the Subject Property cannot be acquired by direct negotiation, it shall be <br />acquired by eminent domain. <br />6. That the City Council hereby authorizes acquisition of the Subject Property by <br />eminent domain and to take title and possession of that land prior to filing of an <br />award by the Court Appointed Commissioners pursuant to Minn.
