/6 •3 al •dS •i4/ •00i64____ <br />Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -06 -217 <br />1581126 <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO ENCROACH <br />FIVE FEET INTO THE REAR YARD SETBACK AND DECLARING TERMS OF <br />SAME <br />WHEREAS, Karl and Beth Virkus (Permittees) have properly applied for a variance <br />from Section 9.11.02 of the Ramsey City Code to construct a home addition that will encroach <br />five feet into the rear yard setback on the property generally known as 16940 Azurite Street and <br />legally described as follows: <br />Lot 4, Block 4, Shady Lawn Estates, Anoka County, Minnesota <br />(Subject Property). <br />AND WHEREAS, the Board of Adjustment conducted a public hearing on June 5, 2001, <br />pursuant to Section 9.03.05 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0554, a variance to encroach into the 35 -foot rear yard <br />setback on the Subject Property is hereby granted. <br />2. That the home addition shall maintain a 30 -foot setback from the rear property line. <br />3. That the Permittee shall obtain all the necessary permits for the home addition prior to <br />commencing any construction of the accessory structure. <br />4. That the property owner shall be responsible for all costs incurred in administering and <br />enforcing this variance. <br />5. That the accessory structure portion of the addition shall be used for storage of personal <br />property and that no commercial activity of any type shall be permitted in said structure, <br />unless it is in accordance with City Code. <br />• 6. That this Variance shall automatically expire if the use is not initiated by June 30, 2002 and <br />issuance of the building permit shall constitute initiation. <br />
