Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -06 -218 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0055 RELATING TO A REQUEST <br />FOR A VARIANCE FROM THE SIDE YARD AND SEPTIC SYSTEM SETBACK <br />REQUIREMENTS <br />WHEREAS, John and Julie Dehen, hereinafter referred to as "Applicants," have properly <br />applied for a variance from Sections 9.20.11 and 8.30.05 of the Ramsey City Code to construct a <br />garage with zero side yard setback and a septic tank that will be closer than 10 feet to the <br />dwelling on the property generally known as 14806 Bowers Drive N.W. and legally described as <br />follows: <br />Unplatted Ramsey Township that part of Government Lot 1, Section 30, <br />Township 32, Range 25, Anoka County, Minnesota described as follows: <br />From the Northwest corner of said Government Lot 1, an iron monument on the <br />bank of the Mississippi River, thence 14 degrees, 50 minutes East a distance of <br />785 feet to a point on the top of the high bank along said river which is the point <br />of beginning. Thence East and parallel with the North line of said Government <br />Lot 1 a distance of 286 feet, thence North at right angles 200 feet, thence North 62 <br />degrees 20 minutes West 312 feet to the top of the high bank along said river, <br />thence Southerly along said high bank 350 feet to the place of beginning. <br />Together with a strip of land about 30 feet wide and 350 feet long adjoining the <br />above described tract on the West being the land lying between the top of said <br />high bank and low water in said river and continuing in all 2 acres -which lies <br />Northerly of the following described line: <br />Beginning at a point on the East line of the above described tract, distance 155.3 <br />feet North of the Southeast cornor thereof. Thence deflect to the left at an angle <br />of 65 degrees and 14 minutes for 165.55 feet, thence deflect to the left at an angle <br />of 12 degrees and 53 minutes to an intersection with the Westerly line of said <br />tract, the same being the Easterly low water line of the Mississippi River <br />containing 0.43 acres more or less. <br />(the "Subject Property ") <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on June 5, 2001, and that said public hearing was properly advertised, and <br />that the minutes of said public hearing are hereby incorporated as a part of these findings by <br />reference. <br />2. That the subject property is zoned R -1 Rural Residential and is approximately .4 acres in <br />size. <br />
