• NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />• <br />• <br />1. That based on Findings of Fact #0555, a variance to construct an accessory structure that will <br />encroach on the side yard setback requirement is hereby granted. <br />2. That based on Findings of Fact #0555, a variance to the required separation between septic <br />systems and dwellings is hereby granted. <br />3. That upon successful completion of an administrative subdivision in accordance with City <br />Code to obtain property from the adjacent parcel to the north as proposed, the accessory <br />garage constructed on the Subject Property shall be allowed to occur with a zero setback from <br />the north property line. <br />4. That the septic system shall maintain a five (5) foot setback from the dwelling.. <br />5. That the Permittees shall obtain all necessary permits prior to commencing any construction <br />of the accessory structure or septic system. <br />6. That the accessory structure shall be used for storage of personal property and no commercial <br />activity shall be permitted within said structure, unless it is done in accordance with City <br />Code. <br />7. That the Permittees shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br />8. That this Variance shall automatically expire if the use is not initiated by June 5, 2003, and <br />issuance of the building permit shall constitute initiation. <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Watson, and upon vote being taken thereon, the following voted in favor thereof: <br />Chairperson Nixt <br />Board Member Johnson <br />Board Member Watson <br />Board Member Kociscak <br />Board Member Reeves <br />Board Member Sweet <br />and the following voted against the same: <br />None <br />Resolution #01 -06 -219 <br />Page 2 of 4 <br />
