• <br />PARCEL 3: <br />The Northeast quarter of the Southeast quarter of Section 26, Township 32, Range <br />25, Anoka County, Minnesota. <br />(the "Subject Property ") <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on June 5, 2001 and that said public hearing was properly advertised and <br />that the minutes of said public hearing are hereby incorporated as a part of these findings by <br />reference. <br />2. That the subject property is proposed to be rezoned from B1, Business and R1, Single Family <br />to Planned Unit Development (P.U.D.). <br />3. That the subject property is proposed to be subdivided to allow for 73 single - family lots, 152 <br />townhome units, and an 82 -unit apartment building for senior citizens. <br />• 4. That City Ordinances restrict structure heights to 35 feet in all zoning districts. <br />5. That the Applicant is proposing to construct a three story apartment building that will reach a <br />maximum height of 52 feet and therefore exceeds the 35 -foot height restriction by 17 feet. <br />6. That the proposed structure is proposed to house at least 82 senior citizens, some of which <br />may have limited mobility to escape from a fire. <br />7. The applicant has provided staff with information regarding the height of the third story <br />windows. In all locations on the building, the bottom of the third story window is below 35 <br />feet. The lowest point of the third story windows range from 23' 10" to 32' 7 ". The top of <br />the third story windows range from 27' 8" to 36' 6 ". <br />8. That the 35 -foot height restriction is based on the reach capabilities of fire suppression <br />equipment in the City's fire department. <br />9. That the special conditions causing the hardship; namely that the restriction on structure <br />height is based on fire suppression reach capabilities, do /do not result from the actions of the <br />Applicant. <br />10. That if granted, the variance will grant special privilege that is denied to other owners of <br />lands, structures or buildings in the same district. <br />RESOLUTION #01 - - 220 <br />Page 2 of 3 <br />
