That if the accessory structure were to be constructed in the rear yard, it would intensify the <br />existing encroachment on the 200 foot setback from the Mississippi River resulting from <br />the location of the principal structure. <br />9. That similar variances have been granted in the R -1 Rural Residential District in the City of <br />Ramsey generally, and specifically on Bowers Drive. <br />10. That the total amount of existing and proposed accessory structure space on the Subject <br />Property exceeds the permitted maximum by 48 square feet and accordingly, the Applicants <br />have applied for a conditional use permit. <br />11. That the Mississippi River setback requirement imposes a hardship on the Subject Property <br />that is not applicable to other lands in the same district. <br />12. That the variance requested is the minimum variance necessary to accomplish the intended <br />purpose of the Applicant, minimize destruction of mature trees, and comply with the <br />setback from the Mississippi River Ordinary High Water mark. <br />13. That, if granted, the variance will not increase the congestion in the public street. <br />14. That, if granted, the variance will not adversely impact the degree of public health, safety <br />and general welfare provided for in the Ramsey City Code. <br />15. That, if granted, the variance will not diminish established property values within the <br />neighborhood. <br />16. That the unique circumstances on the Subject Property do not result from the actions of the <br />Applicant. <br />17. That, if granted, the will not grant the Applicant any special privilege that is denied to the <br />owners of other land in the same district. <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Watson, and upon vote being taken thereon, the following voted in favor thereof: <br />Chairperson Nixt <br />Board Member Johnson <br />Board Member Watson <br />Board Member Kociscak <br />Board Member Reeves <br />Board Member Sweet <br />and the following voted against the same: <br />None <br />RESOLUTION #01 -06 -222 <br />Page 2 of 3 <br />
