• <br />Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -06 -223 _.5D\ v -013O5 <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CONSTRUCT AN <br />ACCESSORY STRUCTURE NEARER THE FRONT PROPERTY LINE THAN THE <br />PRINCIPAL STRUCTURE AND DECLARING TERMS OF SAME <br />WHEREAS, Charles and Kathleen Davis (Permittee) have properly applied for a <br />variance from Section 9.11.02 of the Ramsey City Code to construct an accessory structure <br />nearer the front property line than the principal structure on the property generally known as <br />14490 Bowers Drive N.W. and legally described as follows: <br />Lot 28, Bower's Mississippi Acres, Anoka County, Minnesota <br />(Subject Property). <br />1586640 <br />• AND WHEREAS, the Board of Adjustment conducted a public hearing on June 5, 2001, <br />pursuant to Section 9.03.05 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0557, a variance to construct a 24'x40' accessory structure <br />nearer the front property line than the principal structure on the Subject Property is hereby <br />granted. <br />2. That the accessory structure constructed on the Subject Property shall not be located any <br />closer than 140 feet from the front property line and 215 from the Ordinary High Water mark <br />of the Mississippi River. <br />3. That no other structures or additions shall be constructed in the reduced front yard setback <br />unless the property owner applies for and is granted a variance for same. <br />4. That the property owner shall be responsible for all costs incurred in administering and <br />enforcing this variance. <br />5. That the Permittee shall obtain all necessary permits prior to commencing any co nstruction of <br />the accessory structure. <br />6. That the accessory structure shall be used for storage of personal property and that no <br />commercial activity of any type shall be permitted in said structure. <br />
