Councilmember Hendriksen introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -06 -234 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0559 RELATING TO A <br />REQUEST FROM CHARLES AND KATHLEEN DAVIS FOR A CONDITIONAL USE <br />PERMIT TO EXCEED THE MAXIMUM ACCESSORY STRUCTURE SQUARE <br />FOOTAGE RESTRICTIONS. <br />WHEREAS, Charles and Kathleen Davis„ hereinafter referred to as the "Applicants," <br />have properly applied for a Conditional Use Permit to exceed the maximum accessory structure <br />square footage restrictions on the property generally known as 14490 Bowers Drive N.W. and <br />legally described as follows: <br />Lot 28, Bowers Mississippi Acres, Anoka County, Minnesota <br />( "Subject Property ") <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br />1. That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on June 5, 2001, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br />2. That the Subject Property is approximately .7 acres in size. <br />3. That Section 9.11.02 (Accessory Uses), Subd. 12 (Size Restrictions and Performance <br />Standards for Accessory Buildings in Residential Districts) allows up to 3 accessory <br />buildings not exceeding a total of 1,488 square feet on the Subject Property. <br />4. That the City policy is that accessory buildings 120 square feet and less in size are not subject <br />to the accessory structure space restrictions because they do not require a building permit and <br />are therefore not considered to be permanent structures. <br />5. That there is a 120 square foot storage shed and a 576 square foot attached garage on the <br />property, which results in 912 square feet of eligible accessory structure space remaining on <br />the Subject Property. <br />6. That the Applicants are proposing to add a 960 square foot accessory building to the Subject <br />Property, for a total of 1,536 square feet of accessory structure space; this is a 48 square foot <br />overage in the amount of accessory structure space permitted on the Subject Property. <br />• 7. That the Applicants have stated that the accessory building will be for storage of personal <br />items and no commercial activity will be conducted in the building. <br />8. That in accordance with City Code, the proposed building will be constructed of materials <br />like the home; lap, cedar siding and asphalt shingles. <br />
