• 1588343 3 3 ; c 5 - q 1 a-os Councilmember Zimmerman introduced the following resolution and moved for its adoption: RESOLUTION #01 -06 -235 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO CHARLES AND KATHLEEN DAVIS TO EXCEED THE MAXIMUM ACCESSORY STRUCTURE SPACE RESTRICTIONS BASED ON FINDINGS OF FACT #0559 AND DECLARING TERMS OF SAME: WHEREAS, Charles and Kathleen Davis, hereinafter referred to as the "Permittee ", have properly applied for a Conditional Use Permit to exceed the amount of accessory building space allowed on the property generally known as 14490 Bowers Drive N.W. and legally described as follows: Lot 28, Bowers Mississippi Acres, Anoka County, Minnesota ( "Subject Property ") WHEREAS, the Planning Commission met on June 5, 2001, conducted the public hearling and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. Based on Findings of Fact #0559, a Conditional Use Permit (Permit) to exceed the amount of accessory structure space allowed on the Subject property, as established in City Code, is hereby granted to the Permittee. 2. That the Permittee is allowed to have a maximum of 1,536 square feet of accessory structure space on the Subject Property. 3. That the construction of the new accessory building will require issuance of a building permit from the City of Ramsey. 4. That the accessory building shall be properly constructed and maintained in accordance with all applicable Uniform Building Codes. 5. That the construction of the new accessory building shall meet all applicable setbacks unless • a variance is granted.. 6. The Permittee herein agrees that a business will not be operated in the accessory buildings unless it is in accordance with City Code.
