Councilmember Zimmerman introduced the following resolution an moved for its adoption: <br />RESOLUTION #01 -06 -236 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0560 RELATING TO A <br />REQUEST FOR AN INTERIM USE PERMIT TO ESTABLISH AN OUTDOOR <br />PAINTBALL RECREATIONAL USE ON A PROPERTY THAT IS ZONED <br />INDUSTRIAL <br />WHEREAS, Brian Gower, dba Diehard Paintball, (Permittee) has properly applied for <br />an interim use permit to establish an outdoor paintball course on the property generally know as <br />14622 Ferret Street and legally described as follows: <br />Lot 2, Block 1 Hy -10 Ramsey, together with that part of the Southwest Quarter of <br />the Northeast Quarter of Section 29, Township 32, Range 25, Anoka County, <br />Minnesota, lying northeasterly of the northeasterly line of the Burlington Northern <br />Railroad. <br />(the " Subject Property") <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on June 5, 2001, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br />2. That the subject property is located in the Industrial District and is approximately 9 acres in <br />size. <br />3. That the surrounding parcels are zoned Industrial and B -3 Highway Business. <br />4. That section 9.20.25 of City Code does not permit outdoor recreational uses in an <br />Industrial district. <br />5. That the Subject Property is in close proximity to the smart growth site and designated for <br />mixed -use in the March 2001 draft Comprehensive Plan. <br />6. That in 1988 and 1994 the City issued a Conditional Use Permit to the Subject Property for <br />outdoor recreational uses to include a go -cart track, miniature golf course, bumper boats, <br />batting cages, and a driving range. <br />• 7. That the Applicant has submitted a site plan to establish a paintball course on the subject <br />property. <br />
