NOV (J ! 7O;I1 <br />/9 s . ; ; 5 .w3_c5c -�� <br />Councilmember Kurak introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -06 -239 <br />1605211 <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO ESTABLISH WAREHOUSE OPERATIONS AS AN ACCESSORY USE TO AN <br />OFFICE BUILDING IN THE B -1 BUSINESS BASED UPON FINDINGS OF FACT #0561 <br />AND DECLARING TERMS OF SAME <br />WHEREAS, SW Wold ( Permittee) has properly applied for a conditional use permit <br />(CUP) for warehousing activities in a B -1 District on the property legally described as follows: <br />Lot 2, Block 1, Ramsey Commercial Park, 2n Anoka County, Minnesota <br />(the Subject Property); and <br />WHEREAS, the Planning Commission met on June 5, 2001, conducted a public hearing <br />and recommended City Council approval of the request. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) This permit is contingent upon the Permittee obtaining site plan approval as established <br />in Section 9.03.06 (Site Plan Review) of the Ramsey City Code and shall be perpetual in <br />its duration so long as the conditions imposed herein are complied with. <br />2) The development and operation of the office /warehouse shall be specifically limited to <br />that described in the Permittee's approved Site Plan consisting of 5 sheet(s) prepared by <br />Lampert Architects dated May 15, 2001. <br />3) That 19,075 square feet of the building on the Subject Property will be designated for <br />warehousing activities. <br />4) Off - street truck parking shall not encroach on the required off - street customer /employee <br />parking required by the district regulations in affect at any given time. <br />5) If any provision of this CUP shall be declared void or unenforceable, the other provision <br />shall not be affected but shall remain in full force and effect. <br />6) This CUP shall not be considered modified, altered, changed or amended in any respect <br />unless in writing and signed by the City and the Permittee. <br />7) Amendment, Suspension or Revocation of CUP: The violation of any of the material <br />terms of this CUP is grounds for suspension or revocation hereof, consistent with <br />applicable law.
