• <br />• <br />36. Violation of Conditions. If the Permittee or its successors or assigns violates any material <br />term or condition imposed by this Permit, it may be revoked and terminated consistent with <br />applicable law. <br />37. On - Site Inspection. The City reserves the right to inspect the site for the purposes of <br />examining and copying nonprivileged records; conducting inspections, surveys, <br />investigations, monitoring or sampling; and obtaining necessary information pertaining to <br />the construction, operation and environmental effect of the aluminum processing facility. <br />Inspections shall be conducted during normal business hours except in the event of an <br />emergency. City personnal or agents performing the inspection will provide reasonable <br />notice to the Permittee's personnel prior to the time of inspection. <br />38. Documents and Plans. Copies of all documents, plans or other reports which are required <br />to be supplied to the MPCA or Anoka County shall also be supplied concurrently to the City <br />at no cost to the City. <br />39. Operations. This permit is based on conduct of operations as described in the Permitte's <br />submittals as follows: <br />A. Site plan dated May 23, 2001; and <br />B. Letter from Permittee to the Planning Commission dated May 25, 2001. <br />• The identified supporting documents are incorporated herein by reference. <br />40. Administrative Costs. All costs incurred by the City in administering and enforcing this <br />Permit shall be the responsibility of the Permittee. <br />41. Contingency. This Permit is contingent upon the termination of the existing Conditional <br />use Permit issued to Danny's Aluminum Processing, Inc. pursuant to City Resolution #93- <br />03 -033, and this Permit shall not become effective until said existing Conditional Use Permit <br />has been terminated as determined by the City. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Anderson, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Kurak <br />Councilmember Anderson <br />Councilmember Zimmerman <br />and the following voted against the same: <br />Councilmember Hendriksen <br />RESOLUTION #01 -06 -241 <br />Page 7 of 9 <br />
