Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #01- 08 -257A <br />RESOLUTION ADOPTING FINDINGS OF FACT #0564 RELATING TO A REQUEST <br />FROM THOMAS AND CAROLE RACHEL FOR A VARIANCE TO ENCROACH <br />TWENTY FEET INTO THE SIDE YARD SETBACK ON THE PROPERTY LOCATED <br />AT 6350 163 LANE. <br />WHEREAS, Thomas and Carole Rachel, hereinafter referred to as "Applicants," have <br />properly applied for a Board of Adjustment variance from Section 9.11.02 of the Ramsey City <br />Code to construct a detached accessory structure that encroaches twenty feet into the rear yard <br />setback on the property generally known as 6350 163 Lane NW and legally described as <br />follows: <br />Lot 1, Block 4, Menkvelds Country Park, Anoka County, Minnesota <br />( "Subject Property "). <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on August 7, 2001, and that said public <br />hearing was properly advertised, and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />2. That the Subject Property is zoned R -1 Rural Residential and is approximately .7 acres in <br />size. <br />3. That the Subject Property is surrounded by R -1 Rural Residential zoning. <br />4. That Section 9.20.11 of the Ramsey City Code requires a 35 -foot side yard setback for <br />corner lots. <br />5. That the location of the drain field, alternate drain fields, and mature trees on the Subject <br />Property limits the location of the detached accessory structure. <br />6. That the Applicant is proposing to construct a 672 square foot detached accessory structure <br />that will be approximately 15 feet from the side yard property line. <br />7. That the total amount of accessory structure space on the Subject Property does not exceed <br />the accessory structure restrictions established in section 9.11.02 of City Code. <br />• 8. That the location of the drain fields and mature trees on the Subject Property is not a direct <br />result of actions of the Applicants. <br />
