1614246 <br />Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #01- 08 -257B <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO ENCROACH <br />TWENTY FEET INTO THE SIDE YARD SETBACK AND DECLARING TERMS OF <br />SAME <br />WHEREAS, Thomas and Carole Rachel ( "Permittees ") have properly applied for a <br />variance from Section 9.11.02 of the Ramsey City Code to construct a detached accessory <br />structure that will encroach twenty feet into the side yard setback on the property generally <br />known as 6350 163r`` Lane and legally described as follows: <br />Lot 1, Block 4, Menkveld Country Park, Anoka County, Minnesota <br />(Subject Property). <br />AND WHEREAS, the Board of Adjustment conducted a public hearing on August 7, <br />2001, pursuant to Section 9.03.05 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0564, a variance to encroach into the 35 -foot side yard <br />setback on the Subject Property is hereby granted. <br />2. That the detached accessory structure shall maintain a 15 -foot setback from the side property <br />line along Wolfram Street. <br />3. That the Permittee shall obtain all the necessary permits for the detached accessory structure <br />prior to commencing any construction. <br />4. That the property owner shall be responsible for 72% of the costs incurred in administering <br />and enforcing this variance. <br />5. That the accessory structure shall be used for storage of personal property and that no <br />commercial activity of any type shall be permitted in said structure, unless it is in accordance. <br />with City Code. <br />DO 6. That this Variance shall automatically expire if the use is not initiated by August 30, 2002 <br />and issuance of the structure permit shall constitute initiation. <br />
