Councilmember Hendriksen introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -08 -309 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0564 RELATING TO A <br />REQUEST TO REZONE CERTAIN PROPERTY FROM INDUSTRIAL TO R -3 URBAN <br />RESIDENTIAL. <br />WHEREAS, on July 10, 2001, the City of Ramsey (the "City ") received an application <br />from TSM Development, Inc. to rezone certain property in accordance with Section 9.03.03 <br />(Zoning Amendments) of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That TSM Development, Inc., hereinafter referred to as "Applicant," has properly applied <br />to rezone the following legally described property from Industrial to R -3 Urban <br />Residential: <br />Outlot A, Regency Pond, Anoka County, Minnesota <br />(the "Subject Property ") <br />2. That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />the City Code on August 7, 2001, and said public hearing was properly advertised, and the <br />minutes of said public hearing are hereby incorporated by reference. <br />3. That the total area of the property to be rezoned is 4.77 acres in size. <br />4. That the proposed rezoning is located within the Metropolitan Urban Service Area (MUSA) <br />boundary. <br />5. That the Subject Property is currently zoned Industrial; the adjacent property to the east and <br />north is zoned R -1 Urban Residential; the property on the west side of Ramsey Blvd. N.W. <br />is zoned Industrial; the adjacent property to the south is zoned Industrial; and the property <br />on the south side of Industry Avenue (C.S.A.H. #116) is zoned Business Warehouse. <br />6. That the Applicant has submitted a general development plan that proposes to develop the <br />property with townhomes at a density that will not exceed the R -3 Urban Residential <br />maximum of 7 units per acre. <br />7. That the current Comprehensive Plan identifies the Subject Property for development with <br />industrial uses. <br />8. That the March, 2001 Draft Comprehensive Plan currently being considered for adoption <br />by the City Council suggests development of the Subject Property with places to work. <br />9. That approval of the rezoning request is inconsistent with the current Comprehensive Plan <br />and the March 2001 draft Comprehensive Plan and will require an amendment to the <br />Comprehensive Plan. <br />
