• <br />Councilmember Hendriksen moved for the adoption of the following resolution: <br />RESOLUTION #01 -08 -310 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0567 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT TO DISPLAY AN ADVERTISING <br />SIGN IN A RESIDENTIAL DISTRICT <br />WHEREAS, Timothy Bergersen, hereinafter referred to as "Applicant ", has properly applied for <br />a Conditional Use Permit to display an advertising sign at his home on the property generally <br />known as 6211 167` Avenue N.W. and legally described as follows: <br />That part of the Northwest Quarter of the the Southwest Quarter of Section 11, <br />Township 32, Range 25, Anoka County, Minnesota, lying Easterly of West 726 <br />feet of said Quarter, Quarter; except that part described as follows: Beginning at <br />the intersection of East line of said Quarter, Quarter and Northerly Right of Way <br />line of 167 Avenue NW (said point being 33 feet North of South line of said <br />Quarter, Quarter), thence Northerly along said East line 540 feet, thence Westerly <br />at right angle 270 feet, thence Southerly parallel with said East line 540 feet to <br />said Northerly right of way line, thence Easterly along said Northerly right of way <br />line 270 feet to point of beginning; also except road subject to easement of record. <br />(the "Subject Property "). <br />• NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on August 7, 2001, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated by reference. <br />2. That the subject property is located on a Municipal State Aid road in a R -1 Rural <br />Residential District and is approximately 13.8 acres in size. <br />3. That the surrounding parcels are zoned R -1 Rural Residential. <br />4. That Section 9.12 (Signs) of City Code does not specifically provide for advertising signs <br />in residential districts. <br />5. That in July of 2000, the City received a complaint regarding a large sign that had been <br />erected on the Subject Property advertising the Applicant's landscaping business. <br />6. That City Staff notified the Applicant that in order to comply with City Code, removal of <br />the sign or a conditional use permit for the use of the sign would be required. <br />7. That the size of the sign erected is 32 square feet. <br />
