3. Maintenance. The surface and structure of the sign must be kept refinished as necessary <br />and to the City's satisfaction, to prevent the sign surface and support structure from <br />becoming unkempt in appearance and structurally sound. <br />4. Severability: If any provision of this Permit shall be declared void or unenforceable, the <br />other provision shall not be affected but shall remain in full force and effect. <br />5. Modification: This CUP shall not be considered modified, altered, changed or amended <br />in any respect unless in writing and signed by the City and the Permittee. <br />6. Amendment, Suspension or Revocation of Permit: The violation of any of the material <br />terms of this Permit is grounds for suspension or revocation hereof, consistent with <br />applicable law. Furthermore, the City reserves the right to amend, suspend or revoke this <br />Permit consistent with applicable law as reasonably required to protect the public health, <br />safety and welfare and the environment. Specifically, but without limiting the foregoing, <br />the City may amend, suspend or revoke this Permit consistent with applicable law if the <br />City Council reasonably determines that continued use of the sign places the public <br />health, safety, or welfare, or the environment in jeopardy or creates a public nuisance. <br />7. On -Site Inspection: The City reserves the right to inspect the sign for the purposes of <br />determining compliance with this Permit and obtaining necessary information pertaining <br />to the use of the sign. Inspections shall be conducted during normal business hours <br />except in the event of an emergency. City personnel or agents performing the inspection <br />shall provide reasonable notice to the Permittee prior to the time of the inspection. <br />8. Administration of Permit: All costs incurred by the City in administering and enforcing <br />this Permit shall be the responsibility of the Permittee. <br />9. As development would occur on or near the property that would require removal of the <br />sign, Mr. Bergersen will be responsible for removing the sign. <br />The motion for the adoption of the foregoing resolution as duly seconded by Councilmember <br />Anderson, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Hendriksen <br />Councilmember Anderson <br />Councilmember Kurak <br />Councilmember Zimmerman <br />and the following voted against the same: <br />None <br />RESOLUTION #01 -08 -311 <br />Page 2 of 4 <br />
