City Administrator Norman replied that he has currently not been able to locate the tape, but has <br />contacted the cable company for a copy. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to include <br />the wording as stated by the Met Council at the August l0th meeting in regards to the septic <br />system inspection. <br /> <br />Further discussion: Councilmember Zimmerman explained that the requirements stated by Met <br />Council on August 10th were the requirements to get the Comprehensive Plan approved and if the <br />wording is included in the plan then the obligation of the City would be met. Councilmember <br />Anderson replied that she did not feel it was a professional way to explain the requirements. <br />Councihnember Hendriksen inquired if the Met Council has the authority to require something <br />less stringent than state law. City Attorney Goodrich replied no. Councilmember Hendriksen <br />suggested adding what was stated by the Met Council at the August l0th meeting, but include the <br />wording "not less stringent that state law". Mr. Hendriksen explained that in the past the Met <br />Council has been more stringent than state law and at the August l0th meeting, they seemed to <br />back-off the more stringent guidelines and he wants to prevent the citizens from being required <br />to do more than required by State law. <br /> <br />Councilmember Hendriksen and Councilmember Zimmerman withdrew their motion. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to change the <br />wording relating to septic system inspection to read "consistent with Minnesota rule section <br />7080". <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Connolly. Voting No: None. <br /> <br />Councilmember Hendriksen stated that on page V-17 in the sentence "in order to insure .... "it <br />currently has the word "certain" relating to a PUD and consensus of the Council was to change <br />the word "certain" to "ali" unless there is appropriate justification from the consultant for the <br />word "certain". <br /> <br />Counciimember Zimmerman noted that on Subdivision Ordinance page 16-3 item #4 reads <br />"...required that it be submitted in electronic format...," but not all companies have that capability <br />and suggested changing "required" to "encourage". <br /> <br />The consensus of the Council was to change the word "required" to "encourage". <br /> <br />Councihnember Anderson noted that on the bottom of page 16-3 there is a reference to the septic <br />system inspection and the wording should be changed to be consistent with the previous motion. <br /> <br />City Council/December 14, 1999 <br /> Page 10 of 18 <br /> <br /> <br />
