• • • Councilmember Kurak introduced the following resolution and moved for its adoption: RESOLUTION #01 -09 -336 RESOLUTION TO ENTER INTO AND EXECUTE A LIMITED -USE PERMIT WITH THE MINNESOTA DEPARTMENT OF TRANSPORTATION (MnDOT) FOR THE PURPOSE OF CONSTRUCTING, MAINTAINING AND OPERATING A TRAIL WITHIN THE RIGHT -OF -WAY ALONG TRUNK HIGHWAY 47 WHEREAS, the City of Ramsey requests to work cooperatively with MnDOT to construct, maintain and operate a trail Improvement with the right of way of Trunk Highway 47 in the City of Ramsey, south of Xkimo Street NW; and, WHEREAS, said trail will be a eight foot wide bituminous pathway; and, WHEREAS, portions of the trail improvements, are located within the MnDOT right -of- way; and, WHEREAS, the Minnesota Department of Transportation requires Limited -Use Permits for trails within their rights -of -way; and, WHEREAS, the Limited - Use - Permit requires that the City of Ramsey agrees to indemnify MnDOT from damage resulting from trail usage: NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA: 1) That the City Council does hereby authorize the City Administrator to enter into the Limited Use Permit C.S. 0206(56= 110)901. The motion for the adoption of the foregoing resolution was duly seconded by Mayor Gamec, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Kurak Councilmember Anderson Councilmember Hendriksen Councilmember Zimmerman and the following voted against the same: None and the following abstained: None
