• <br />1. Based on Findings of Fact #0574, a conditional use permit (Permit) to exceed accessory <br />structure square footage restrictions as established in City Code, is hereby granted to Bradley <br />Wolf, hereinafter referred to as the "Permittee" <br />2. That the Permittee is allowed to maintain 7,824 square feet of accessory structures on the <br />Subject Property. <br />3. That the Permittee shall remove the existing 2,470 square foot (38' x 65') accessory building, <br />and shall comply with all City and outside agency guidelines when removing the building <br />from the property. <br />4. That the construction of a new detached accessory building shall not exceed 3,840 square feet <br />in size. <br />5. That the construction of the new accessory building shall meet all applicable setbacks. <br />6. The Permittee herein agrees that the accessory structure shall be used for agricultural <br />purposes as defined by Minnesota State Statute Section 273.13 and /or personal residential <br />storage. <br />7. That this Permit shall be perpetual in duration as long as the terms herein are complied with. <br />8. That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Permit. <br />9. That the City Administrator, or his/her designee, shall have the right to inspect the premises <br />for compliance and safety purposes annually or at any time, upon reasonable request. <br />10. This Conditional Use Permit shall automatically expire if it is not initiated by September 25, <br />2002. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Anderson, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Kurak <br />Councilmember Anderson <br />Councilmember Hendriksen <br />Councilmember Zimmerman <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />RESOLUTION #01-09 - <br />Page 2 of 3 <br />
