• <br />Councilmember Hendriksen introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -09 -363 <br />A RESOLUTION DENYING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT #0575 AND DECLARING TERMS OF PERMIT. <br />WHEREAS, Don and Nancy Young have properly applied for a conditional use permit <br />to maintain a second dwelling on the property generally known as 6421 154 Lane and legally <br />described as follows: <br />The East 200.0 feet of the West 2,266 feet of that part of the South half of the Northeast <br />Quarter of Section 22, Township 32, Range 25, Anoka County, Minnesota, lying north of <br />the South 986.35 feet of said South half of Northeast Quarter (subject to easements of <br />record). <br />( "Subject Property "). <br />WHEREAS, the Planning Commission met on September 4, 2001, conducted the public <br />hearing and recommended City Council deny the request. <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. Based on Findings of Fact #0575, a conditional use permit ( "Permit ") to maintain a second <br />dwelling on the Subject Property is hereby denied to Don and Nancy Young ( "Permittees "). <br />2. The Permittees shall be responsible for all City costs incurred in processing this Permit. Said <br />expenses shall be paid within 15 days of billing by the City and failure to pay the City's <br />expenses within the 15 day billing period will permit the City to draw upon any of the <br />escrows required by this agreement for payment. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Hendriksen <br />Councilmember Zimmerman <br />Councilmember Anderson <br />Councilmember Kurak <br />and the following voted against the same: <br />None <br />
