• Councilmember Hendriksen introduced the following resolution and moved for its adoption: RESOLUTION #01 -09 -363 A RESOLUTION DENYING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT #0575 AND DECLARING TERMS OF PERMIT. WHEREAS, Don and Nancy Young have properly applied for a conditional use permit to maintain a second dwelling on the property generally known as 6421 154 Lane and legally described as follows: The East 200.0 feet of the West 2,266 feet of that part of the South half of the Northeast Quarter of Section 22, Township 32, Range 25, Anoka County, Minnesota, lying north of the South 986.35 feet of said South half of Northeast Quarter (subject to easements of record). ( "Subject Property "). WHEREAS, the Planning Commission met on September 4, 2001, conducted the public hearing and recommended City Council deny the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. Based on Findings of Fact #0575, a conditional use permit ( "Permit ") to maintain a second dwelling on the Subject Property is hereby denied to Don and Nancy Young ( "Permittees "). 2. The Permittees shall be responsible for all City costs incurred in processing this Permit. Said expenses shall be paid within 15 days of billing by the City and failure to pay the City's expenses within the 15 day billing period will permit the City to draw upon any of the escrows required by this agreement for payment. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Zimmerman, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Hendriksen Councilmember Zimmerman Councilmember Anderson Councilmember Kurak and the following voted against the same: None
