Chairperson Nixt introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -10 -369 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0577 RELATING TO A REQUEST <br />FROM DAN AND THERESA CARTER FOR A VARIANCE TO ENCROACH <br />FOURTEEN AND A HALF FEET INTO THE REAR YARD SETBACK ON THE <br />PROPERTY LOCATED AT 14531 SUNFISH LAKE DRIVE. <br />WHEREAS, Dan and Theresa, hereinafter referred to as "Applicants," have properly <br />applied for a Board of Adjustment variance from Section 9.11.02 of the Ramsey City Code to <br />construct a home addition that encroaches fourteen and a half feet into the rear yard setback on <br />the property generally known as 14531 Sunfish Lake Dr. and legally described as follows: <br />Lot 7, Block 2, Sunfish Lake Estates, Anoka County, Minnesota <br />( "Subject Property "). <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on October 4, 2001, and that said public <br />hearing was properly advertised, and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />2. That the Subject Property is zoned R -1 Single Family Residential and is approximately <br />11,294 square feet (.25 acres) in size. <br />3. That the Subject Property is surrounded by R -1 Single Family Residential zoning. <br />4. That the Applicant is proposing to construct a 473 square foot addition to the existing <br />principal structure that will be approximately 20.5 feet from the rear property line. <br />5. That Section 9.20.11 of the Ramsey City Code requires a 35 -foot rear yard setback. <br />6. That the Subject Property is surrounded by three streets; Sunfish Lake Dr., 145` Ave. NW, <br />and Sunwood Drive, which restricts buildable area more than on a comparable lot adjacent <br />to 1 or 2 lots. <br />7. That the applicant is unable to construct the addition anywhere else except in the rear yard <br />due to the fact that alternative locations would negatively encroach into the sideyard <br />setback areas. <br />8. That the rear yard abuts the right of way of Sunwood Drive. <br />
