, <br />Chairperson Nixt introduced the following resolution and moved for its ado <br />tonLF <br />RESOLUTION #01 -10 -370 <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO ENCROACH <br />FOURTEEN AND A HALF FEET INTO THE REAR YARD SETBACK AND <br />DECLARING TERMS OF SAME <br />WHEREAS, Dan and Theresa Carter ( Permittees) have properly applied for a variance <br />from Section 9.11.02 of the Ramsey City Code to construct a home addition that will encroach <br />fourteen and a half feet into the rear yard setback on the property generally known as 14531 <br />Sunfish Lake Dr. NW and legally described as follows: <br />Lot 7, Block 2, Sunfish Lake Estates, Anoka County, Minnesota <br />(Subject Property). <br />AND WHEREAS, the Board of Adjustment conducted a public hearing on October 4, <br />2001, pursuant to Section 9.03.05 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0577, a variance to encroach into the 35 -foot rear yard <br />setback on the Subject Property is hereby granted. <br />2. That the home addition shall maintain a 20.5 -foot setback from the rear property line. <br />3. That the Permittees shall obtain all the necessary permits for the home addition prior to <br />commencing any construction of the accessory structure. <br />4. That the property owner shall be responsible for all costs incurred in administering and <br />enforcing this variance. <br />5. That this Variance shall automatically expire if the use is not initiated by October 4, 2002 and <br />issuance of the building permit shall constitute initiation. <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Johnson, and upon vote being taken thereon, the following voted in favor thereof: <br />Chairperson Nixt <br />Board Member Johnson <br />Board Member Kociscak <br />Board Member Reeve <br />Board Member Sweet <br />Board Member Watson <br />and the following voted against the same: <br />None <br />and the following abstained: <br />
