Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -10 -371 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0578 RELATING TO A REQUEST <br />FROM GARY VOIT FOR A VARIANCE TO ENCROACH TWELVE FEET INTO THE <br />CORNER SIDE YARD SETBACK ON THE PROPERTY LOCATED AT 6198 146 AVE <br />NW. <br />WHEREAS, Gary Voit, hereinafter referred to as "Applicant," has properly applied for a <br />Board of Adjustment variance from Section 9.20.12 (3) of the Ramsey City Code to construct an <br />accessory building that encroaches twelve feet into the corner side yard setback on the property <br />generally known as 6198 146` Ave. NW and legally described as follows: <br />Lot 3, Block 2, Sunfish Lake Estates, Anoka County, Minnesota <br />( "Subject Property "). <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on October 4, 2001, and that said public <br />hearing was properly advertised, and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />2. That the Subject Property is zoned R -1 Single Family Residential and is approximately <br />15,202 square feet (.35 acres) in size. <br />3. That the Subject Property is surrounded by R -1 Single Family Residential zoning. <br />4. That the Applicant is proposing to construct a 576 square foot accessory building <br />approximately 18 feet from the western property line. <br />5. The western property line is considered a corner side yard for setback purposes since it is <br />adjacent Sunfish Lake Drive NW. <br />6. That Section 9.20.12(3) of the Ramsey City Code requires either a 20 -foot corner side yard <br />setback or meet the adjacent setback, whichever is greater. <br />7. That the adjacent setback, located at 14561 Sunfish Lake Drive NW, is 30 feet. <br />8. That under City Code, the applicant would need to adhere to the 30 -foot setback when <br />constructing an accessory building absent a variance. <br />
