Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -10 -372 <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO ENCROACH <br />TWELVE FEET INTO THE CORNER SIDE YARD SETBACK AND DECLARING <br />TERMS OF SAME <br />WHEREAS, Gary Voit, hereinafter referred to as "Applicant," has properly applied for a <br />Board of Adjustment variance from Section 9.20.12 (3) of the Ramsey City Code to construct an <br />accessory building that encroaches twelve feet into the corner side yard setback on the property <br />generally known as 6198 146 Ave. NW and legally described as follows: <br />Lot 3, Block 2, Sunfish Lake Estates, Anoka County, Minnesota <br />( "Subject Property "). <br />1621415 <br />c(c) as ;� (DO "37 <br />AND WHEREAS, the Board of Adjustment conducted a public hearing on October 4, <br />2001, pursuant to Section 9.03.05 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0578, a variance to encroach twelve feet into the required <br />30 -foot corner side yard setback on the Subject Property is hereby granted. <br />2. That the accessory building shall maintain a 18 -foot setback from the western property line. <br />3. That the accessory building shall maintain a 6 -foot setback from the eastern property line. <br />4. That the Permittee shall obtain all the necessary permits for the accessory building prior to <br />commencing any construction of the accessory structure. <br />5. That the property owner shall be responsible for all costs incurred in administering and <br />enforcing this variance. <br />6. That this Variance shall automatically expire if the use is not initiated by October 4, 2002 and <br />issuance of the building permit shall constitute initiation. <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Kociscak, and upon vote being taken thereon, the following voted in favor thereof: <br />
