Councilmember Kurak introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -10 -394 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0580 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FROM JEFF WELLE TO EXCEED <br />THE DETACHED ACCESSORY BUILDING HEIGHT RESTRICTION FOR <br />PROPERTIES LOCATED WITHIN THE METROPOLITAN URBAN SERVICE AREA. <br />WHEREAS, Jeff Welle, hereinafter referred to as the "Applicant," have properly applied <br />for a Conditional Use Permit to exceed the detached accessory building height restriction for <br />properties located in the Metropolitan Urban Service Area (MUSA) on the property generally <br />known as 15351 Ute St. NW and legally described as follows: <br />Lot 2, Block 1, Stanhope Terrace, Anoka County, Minnesota <br />( "Subject Property ") <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br />1. That the Applicants appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on October 4, 2001, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br />2. That the Subject Property is zoned Residential and located within the Metropolitan Urban <br />Service Area (MUSA). <br />3. That the Subject Property is approximately 2.5 acres in size. <br />4. That City Code restricts detached accessory building height to sixteen (16) feet on properties <br />that are located within the Metropolitan Urban Service Area (MUSA). <br />5. That the Applicant would like to exceed the detached accessory building height restriction by <br />a total of 11 -feet in order to match the design and height of the existing residential structure. <br />6. That the Applicant has stated that the detached accessory building will be utilized for <br />personal storage and will not be used to facilitate a business. <br />7. That the detached accessory building will be 30 -feet by 36 -feet (1080 square feet) in size. <br />• 8. That the construction of the detached accessory building will comply with all applicable <br />Uniform Building Codes. <br />9. That the proposed use will not adversely impact traffic in the area. <br />
