• RESOLUTION #01 -10 -396 Lot 2, Block 1, Stanhope Addition, Anoka County, Minnesota (Subject Property) WHEREAS, the Planning Commission met on October 4, 2001, conducted the public hearling and recommended City Council approval of the request. 1624113 4.3 . a5 • t - -cr Councilmember Hendriksen introduced the following resolution and moved for its adoption: A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO EXCEED THE DETACHED ACCESSORY BUILDING HEIGHT RESTRICTION FOR PROPERTIES LOCATED WITHIN THE METROPOLITAN URBAN SERVICE AREA (MUSA) BASED ON FINDINGS OF FACT #0580 AND DECLARING TERMS OF SAME: WHEREAS, Jeff Welle ( Permittee) have properly applied for a conditional use permit to exceed the detached accessory building height restriction for properties located within the Metropolitan Urban Service Area (MUSA) established in section 9.11.02 "Accessory Uses" of City Code on the property generally known as 15351 Ute St. NW and legally described as follows: NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. Based on Findings of Fact #0580, a conditional use permit (Permit)to exceed the detached accessory building height restriction for properties located within the MUSA as established in City Code, is hereby granted to Jeff Welle, hereinafter referred to as the " Permittee" 2. That the detached accessory building may exceed the sixteen (16) foot detached accessory building height restriction for properties located within the Metropolitan Urban Service Area by a total of 11 feet in order to match the design and height of the principal structure. 3. That the construction of the detached accessory building on the Subject Property shall require issuance of a building permit from the City of Ramsey. • 4. That the accessory building shall be properly constructed and maintained in accordance with all applicable Uniform Building Codes.
