• <br />said centerline to said north line of the NE VI of the SW ''A of Section 25, thence South 89 <br />degrees 21 minutes 46 seconds West 468.34 feet to the point of beginning. Except the <br />easterly 60.00 feet thereof to be dedicated for highway purposes at the time of platting. <br />(the "Subject Property "); and <br />WHEREAS, the Board of Adjustment met on September 10, 2001, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from height restrictions. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br />1. Based on Findings of Fact #0581, a variance to allow the applicant to exceed the 35 -foot <br />building height restrictions by 17 feet is hereby approved. <br />2. This variance shall automatically expire if it is not initiated by October 23, 2002, and <br />application for building permit shall constitute initiation. The Permittee may petition for <br />an extension of time in which to complete the variance. Such extension shall be <br />requested in writing and filed with the City at least 30 days before the expiration of the <br />original variance. <br />3. The Permittee agrees that this variance shall be recorded in the office of the Anoka <br />County Recorder . <br />4. The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br />5. This variance is contingent upon the property being properly rezoned by the City. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Anderson, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Kurak <br />Councilmember Anderson <br />Councilmember Zimmerman <br />and the following voted against the same: <br />Councilmember Hendriksen <br />and the following abstained: <br />None <br />Resolution #01 -10 -399 <br />Page 2 of 3 <br />
