(the "Subject Property "); and WHEREAS, the Board of Adjustment met on September 10, 2001, conducted the public hearing and adopted findings of fact relating to the request for a variance from height restrictions. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows 1. Based on Findings of Fact #0581, a variance to allow the applicant to exceed the 35 -foot building height restrictions by 17 feet is hereby approved. 2. This variance shall automatically expire if it is not initiated by October 23, 2002, and application for building permit shall constitute initiation. The Permittee may petition for an extension of time in which to complete the variance. Such extension shall be requested in writing and filed with the City at least 30 days before the expiration of the original variance. 3. The Permittee agrees that this variance shall be recorded in the office of the Anoka County Recorder . 4. The Permittee shall be responsible for all City costs incurred in administering and enforcing this variance. 5. This variance is contingent upon the property being properly rezoned by the City. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Anderson, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Kurak Councilmember Anderson Councilmember Zimmerman and the following voted against the same: Councilmember Hendriksen and the following abstained: None Resolution #01 -10 -399 Page 2 of 3
