• <br />558.02 feet easterly of the NW corner of the NE 1/4 of said SW '/4 and the point of beginning <br />of the property to be described; thence South 00 degrees 22 minutes 40 seconds West 83.31 <br />feet; thence South 85 degrees 34 minutes 26 seconds East 274.38 feet; thence northeasterly <br />164.31 feet along a non - tangential curve concave to the southeast having a radius of 215 <br />and a central angle of 43 degrees 47 minutes 14 seconds; thence North 89 degrees 21 <br />minutes 46 seconds East, not tangent to said curve, 106.76 feet to the centerline of State <br />Trunk Highway No. 47; thence northerly 51.70 feet along said centerline to said north line <br />of the NE '/4 of the SW 1 /4 of Section 25, thence South 89 degrees 21 minutes 46 seconds <br />West 468.34 feet to the point of beginning. Except the easterly 60.00 feet thereof to be <br />dedicated for highway purposes at the time of platting. <br />4. That the total area of the property to be rezoned is 10.05 acres in size. <br />5. That the proposed rezoning is located within the Metropolitan Urban Service Area (MUSA) <br />boundary. <br />6. That the Subject Property is currently zoned B -1 Business and R -3U Residential and the <br />surrounding adjacent properties are zoned B -1 Business to the north; B -1 Business, B -2 <br />Business, and Multiple Residential to the south; R -3U Residential and R -1 Residential to <br />the east and west. <br />7. That the Applicant is proposing to develop their land to provide for apartment buildings for <br />senior citizens. <br />8. That the proposed zoning amendment will not substantially adversely impair the use or <br />market value of any surrounding property. <br />9. That the proposed zoning amendment will not change the essential character of the area, <br />which is zoned medium density residential and business. <br />10. That the existing road infrastructure will be capable of accommodating, in a safe manner, <br />the additional traffic to be generated by the rezoned property. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Anderson, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Kurak <br />Councilmember Anderson <br />Councilmember Hendriksen <br />Councilmember Zimmerman <br />and the following voted against the same: <br />None <br />RESOLUTION #01 -10 -400 <br />Page 2 of 3 <br />
