Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -11 -401 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0583 RELATING TO A REQUEST <br />FOR A VARIANCE FROM SEPTIC SYSTEM SETBACK REQUIREMENTS FOR <br />PROPERTY LOCATED AT 16941 YTTRIUM ST. NW. <br />WHEREAS, Jim and Joanne Kusler, hereinafter referred to as "Applicants," have <br />properly applied for a Board of Adjustment variance from Section 8.30.05 of the Ramsey City <br />Code to allow for a septic system to encroach 10 feet into the house setback and 5 feet into the <br />lot line setback for property located at 16941 Yttrium St., NW and legally described as follows: <br />Lot 4, Block 2, Shady Lawn Estates, Anoka County, Minnesota <br />( "Subject Property "). <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on November 5, 2001, and that said public <br />hearing was properly advertised, and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />2. That the Subject Property is zoned R -1R Single Family Residential Rural and is <br />approximately .8 acres in size. <br />3. That the Subject Property is surrounded by R -1R Single Family Residential Rural zoning to <br />the north, south, and west. To the east, the property is bounded by the Fox Ridge Estates <br />P.U.D. <br />4. That the original septic system was constructed in 1977. <br />5. That the system is classified as failed because of a surface discharge of effluent and is <br />required to be replaced. <br />6. The area previously used for the drainfield cannot be used again due to the fact that it <br />contains filled soil and is disturbed. <br />7. That a 10 foot variance to the 20 foot setback from dwellings and 5 foot variance from the <br />lot line is necessary in order for the septic system to maintain a 50 foot setback from the <br />residential well. <br />
