• <br />Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -11 -402 <br />1621414 <br />/ as M Gam/ <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO SEPTIC <br />SYSTEM SETBACK REQUIREMENTS AND DECLARING TERMS OF SAME <br />WHEREAS, Jim and Joanne Kusler, hereinafter referred to as "Applicants," have <br />properly applied for a Board of Adjustment variance from Section 8.30.05 of the Ramsey City <br />Code to allow for a septic system to encroach 10 feet into the house setback and 5 feet into the <br />lot line setback for property located at 16941 Yttrium St., NW and legally described as follows: <br />Lot 4, Block 2, Shady Lawn Estates, Anoka County, Minnesota <br />( "Subject Property "). <br />AND WHEREAS, the Board of Adjustment conducted a public hearing on November 5, <br />2001, pursuant to Section 9.03.05 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0583, a variance for a septic system to encroach into the 20- <br />foot residence setback area and the 10 foot lot line setback area on the Subject Property is <br />hereby granted. <br />2. That the septic system shall maintain a 10 -foot setback from the residence and 5 -foot setback <br />from the lot line. <br />3. That the Permittees shall obtain all the necessary permits and inspections. <br />4. That the property owner shall be responsible for all costs incurred in administering and <br />enforcing this variance. <br />The motion for the adoption of the foregoing resolution was duly seconded by Chairperson Nixt, <br />and upon vote being taken thereon, the following voted in favor thereof: <br />Board Member Johnson <br />Chairperson Nixt <br />Board Member Brauer <br />Board Member Sweet <br />Board Member Watson <br />and the following voted against the same: <br />None <br />ECEOMC� <br />JAN 2 4 2002 <br />
