• <br />1621413 <br />RESOLUTION #01 -11 -404 <br />Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO ENCROACH <br />EIGHT AND HALF FEET AND TWENTY FEET INTO THE REAR YARD SETBACK <br />AND DECLARING TERMS OF SAME <br />WHEREAS, Chad and Michelle Houde, hereinafter referred to as "Applicants," have <br />properly applied for a Board of Adjustment variance from Section 9.20.12 of the Ramsey City <br />Code to allow for the existing residence to encroach eight and a half feet into the rear yard <br />setback and an addition to the existing structure encroach twenty feet into the rear yard setback <br />on the property located at 6831 146 Circle and legally described as follows: <br />Lot 25, Block 1, Regency Ponds, Anoka County, Minnesota <br />( "Subject Property "). <br />• AND WHEREAS, the Board of Adjustment conducted a public hearing on November 5, <br />2001, pursuant to Section 9.03.05 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0584, a variance to encroach 8.5 feet and 20 feet into the 35- <br />foot rear yard setback on the Subject Property is hereby granted. <br />2. That the home addition shall maintain a 15 -foot setback from the rear property line. <br />3. That the Permittees shall obtain all the necessary permits for the home addition prior to <br />commencing any construction of the accessory structure. <br />4. That the property owner shall be responsible for all costs incurred in administering and <br />enforcing this variance. <br />5. That this Variance shall automatically expire if the use is not initiated by November 5, 2002 <br />and issuance of the building permit shall constitute initiation. <br />aE C 0 <br />3 2,101 <br />
