NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br />1. That the Applicant received a conditional use permit from the City in 1997 for the purpose of <br />creating a pond on the subject property and exporting topsoils and said permit expired on <br />October 31, 2001. <br />1. That on October 24. 2001, John Enstrom, hereinafter referred to as "Applicant ", applied for <br />another conditional use permit to complete the grading project on the Subject Property. <br />2. That the applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on November 5, 2001, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />3. That the project consists of creating a pond by excavating an area of 12 acres to a mean <br />depth of six feet, dry the excavated material and export it off the site as topsoil. <br />4. That the Applicant states that the amount of fill exported from the Subject Property has <br />been approximately 70,000 cubic yards and that approximately 46,000 cubic yards remain <br />to be removed. <br />5. That the Applicant has submitted an exhibit which reflects that the project commenced <br />under the conditional use permit issued in 1997 is approximately 60% complete. <br />6. That the Applicant has stated that the proposed haul route for incoming and outgoing <br />trucks will be as depicted on Exhibit A commencing at a point approximately on the <br />northeastern corner of the excavated area and proceeding due north through the cropped <br />parcel and intersecting with County Road #64 at the intersection with Rabbit Street located <br />in Burns Township. <br />7. That no fill materials are proposed to be imported to the site. <br />8. That no blasting will be employed in the grading activity. <br />9. That the existing drainage patterns will not be substantially altered by the proposed grading <br />plan. <br />10. That the grading operation will not increase the traffic to and from the subject property for <br />the period of time the permit is in effect. <br />11. That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare, if the conditions of <br />the conditional use permit are complied with. <br />RESOLUTION #01- 11 -417A <br />Page 2 of 4 <br />
