Public property means property that may be used by all of the public subject to reasonable regulation by a <br /> governmental body. For the purposes of this definition,such property includes city parks or parking lots and school <br /> parking lots or yards, but does not include public streets and highways. <br /> Semi-public property means private property generally open for use by the public but not owned or <br /> maintained by a governmental body.Such property includes without limitation church property,shopping center <br /> property,and other property generally used by patrons of a commercial or private business establishment, but not <br /> including private streets in residential areas. <br /> Vehicle means every device in,upon, or by which any person or property is or may be transported or drawn <br /> upon a highway except devices moved by human power or used exclusively upon stationary rails or tracks. <br /> (Code 1978, §6.02.01) <br /> Sec. 54-70. Traffic regulations. <br /> (a) No person shall operate or halt any vehicle on public or semi-public property carelessly or heedlessly in <br /> disregard of the rights or safety of others. <br /> (b) No person shall park a vehicle,motor vehicle,commercial motor vehicle,or motorcycle in any designated <br /> parking area for disabled persons on public or semi-public property unless such person is physically <br /> handicapped and the vehicle displays an identifying certificate or insignia issued by the state department of <br /> public safety. <br /> (1) For the purposes of this section,the term "physically handicapped"shall include any person who has <br /> sustained an amputation or permanent material disability of either or both arms,or legs,or who has <br /> been otherwise permanently disabled in any manner rendering it difficult and burdensome for him to <br /> walk. <br /> (2) No person charged with violation of this section may be convicted notwithstanding that no identifying <br /> certificate or insignia is displayed on the vehicle if that person is, in fact, physically disabled. <br /> (3) No person shall obstruct any disability parking space, access aisle,or ramp with any material,vehicle, <br /> or object to include the piling of snow in those spaces, unless they are designated emergency vehicles <br /> responding to an emergency or call for service. <br /> (4) It shall be unlawful for property owners or the responsible party to fail to install Handicapped <br /> Accessible signage in accordance with the Minnesota State Accessibility Code and Statute. <br /> (c) It shall be unlawful for a person to park any vehicle for the sole intention to camp,sleep or live and reside <br /> out of on any street. Commercial Vehicle operators in conformance with the Federal Motor Carrier Safety <br /> Act and Minnesota Statutes may utilize appropriate rest stops,truck stops, or as posted to maintain <br /> compliance with mandatory rest periods. <br /> (d) All violations of this section (54-70)are considered a misdemeanor. <br /> (Code 1978, §6.02.02;Ord. Private property. <br /> (a) No vehicles, motor vehicles, or motorcycles shall be driven across or upon any private property without the <br /> written or oral permission of the owner,occupant, or lessee thereof. Written permission may be given by a <br /> posted notice of any kind or description that the owner,occupant,or lessee prefers,so long as it specifies <br /> the kind of vehicles allowed. <br /> (b) It is unlawful for a person to post any notice or sign provided in this section upon lands over which they have <br /> no right,title, interest, or license. <br /> Page 9 of 17 <br />
