Board Member Levine introduced the following resolution and moved for its adoption: <br /> RESOLUTION 406-12-373 <br /> A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br /> TERMS OF SAME. <br /> WHEREAS, Holiday Stationstores, Inc, hereinafter referred to. as "Applicant," has <br /> properly applied for a variance from Section 9.20.25(3)(b) regarding setbacks for parking and <br /> pavement from a public right-of-way on the property located at the southeast corner of Ramsey <br /> Boulevard and US Trunk Highway 10, or legally described as <br /> Lot 3, Block 4, Rivenwick Village <br /> -or upon recording- <br /> Lot 1,Block 1, Holiday Rivenwick Village <br /> WHEREAS, the Board of Adjustment met on December 7, 2006, conducted the public <br /> hearing and adopted findings of fact relating to the request for a variance from the setback from a <br /> public road for parking and paving as part of the development of the Subject Property. <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br /> OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> 1. Based on Resolution #06-12-372 adopting Findings of Fact #0786, a variance to the <br /> setback from right-of-way for parking and paving, as established in Section 9.20.22 of the <br /> Ramsey City Code, is granted for the development of Holiday Stationstores on the <br /> Subject Property. <br /> 2. That the applicant shall maintain a minimum 5 foot setback from the public right-of-way <br /> as reflected in the approved site plan dated Thursday, December 28, 2006. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> Trites Rolle, and upon vote being taken thereon, the following voted in favor thereof: <br /> Acting Chairperson Van Scoy <br /> Board Member Levine <br /> Board Member Trites Rolle <br /> Board Member Brauer <br /> Board Member Hunt <br /> and the following voted against the same: <br /> None <br />
