Acting Chairperson Van Scoy introduced the following resolution and moved for its adoption: <br /> RESOLUTION #06-12-370 <br /> A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO THE FRONT <br /> YARD SETBACK FOR CERTAIN PARCELS IN THE PLAT OF BROOKFIELD <br /> ADDITION, AND DECLARING TERMS OF SAME. <br /> WHEREAS, Oakwood Development, Inc. (Permittee), has properly applied for a <br /> variance from the front yard setback from public street requirement in the R-1 Residential District <br /> on the property generally located south of Trott Brook, west of Nowthen Blvd, and east of <br /> Variolite Street and legally described as follows: <br /> Lots 7-16 and 19-22, Block 3, and Lots 14-16, Block 1, Brookfield lgt Addition, <br /> Anoka County, Minnesota <br /> And <br /> Lots 19-50, Block 3, as shown on the approved preliminary plat of Brookfield, <br /> prepared by Passe Engineering and dated August 26, 2005 <br /> (the "Subject Property") <br /> WHEREAS, the Board of Adjustment met on December 7, 2006, conducted the public <br /> hearing and adopted findings of fact relating to the request for a variance from the front yard <br /> setback requirements on the Subject Property. <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br /> OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> 1. Based on Findings of Fact #0784, a five (5) foot variance to the thirty (30) foot front yard <br /> setback requirement, as established in Section 9.20.11 of the Ramsey City Code, is hereby <br /> granted for the following parcels: Lots 7-16 and 19-22, Block 3, and Lots 14-16, Block 1, <br /> Brookfield lgt Addition; and Lots 19-50, Block 3, as shown on the approved preliminary <br /> plat of Brookfield, prepared by Passe Engineering and dated August 26, 2005. <br /> 2. All of the dwellings constructed on the parcels identified in Item #1 of this Variance shall <br /> maintain a twenty-five (25) foot setback from the public road right-of-way. <br /> 3. No construction shall commence until the approved final plat has been recorded and the <br /> issuance of a building permit. <br /> 4. This Variance will not become null and void within twelve (12) months of the date of <br /> approval so long as the remainder of the plat is developed in accordance with the <br />
