Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> RESOLUTION #06-08-251 <br /> RESOLUTION ADOPTING FINDINGS OF FACT#0772 RELATING TO A <br /> REQUEST FOR A VARIANCE TO THE MAXIMUM FRONT YARD SETBACK <br /> FOR PROPOSED KLEIN BANK IN THE TOWN CENTER ZONING DISTRICT, <br /> SUBDISTRICT TC-2. <br /> WHEREAS Shingobee Builders, Inc hereinafter referred to as "Applicant," has properly <br /> applied for a variance from Section 9.20.25, Subd. 3.b, regarding minimum and maximum front <br /> yard setbacks in the TC-2 sub-district of the Town Center District, on the property legally <br /> described as follows: <br /> Outlot H, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject <br /> Property) <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF <br /> THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> 1. That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of <br /> the Ramsey City Code on August 3, 2006 and that said public hearing was properly <br /> advertised, and that the minutes of said public hearing are hereby incorporated as a part of <br /> these findings by reference. <br /> 2. That the Subject Property is zoned TC-2 Town Center Commercial <br /> 3. That properties to the east and north are zoned Town Center. <br /> 4. That section 9.20.25, Subd. 3.b, establishes a minimum front yard setback of O feet and a <br /> maximum structure setback of 15 feet in order to encourage pedestrian friendly design. <br /> 5. That the Applicant is requesting a variance from the 15 foot maximum front yard setback <br /> in order to construct a bank approximately 325 feet from Sunwood Drive. <br /> 6. That the Town Center Design Guidelines for the TC-2 sub-district allows the <br /> development of larger scale buildings, which oftentimes results in the structures <br /> exceeding the maximum front yard setback. <br /> 7. That the approved master plan anticipated some buildings to be set back from Sunwood <br /> Drive in this area. <br /> 8. That placing all buildings close to Sunwood underutilizes the back of the property. <br /> 9. That the Applicant has stated the variance requested is the minimum variance needed to <br /> alleviate the hardship. <br />
