Rum River Meadows received contingent preliminary plat approval on July 26, 2005. At the <br />same meeting, findings were adopted by the City Council supporting the rezoning of the property <br />to Planned Unit Development (PUD) and the ordinance rezoning the property was introduced. <br />Mr. Trudgeon reviewed that the preliminary plat for Rum Rivers Estates went through <br />considerable discussion and deliberation with the City Council. On July 26, 2005, the City <br />Council granted preliminary plat approval for Rum River Estates contingent on the following <br />items: <br /> 1. Compliance with City Staff Review Letter dated May 6, 2005 <br /> 2. The City having acquired marketable title to the following permanent easements <br /> necessary for the Potassium Street fight-of-way: <br /> <br />Community Development Director Trudgeon reviewed that a majority of the discussion <br />regarding the plat involved the improvement of Potassium Street. The Council has authorized <br />the use of eminent domain to purchase additional land needed for the use as Potassium Street. <br />Staff and City representatives have been in contact with the property owners affected by the <br />Potassium Street project. The City Attorney will give the Council an update on the status of <br />negotiations. Mr. Trudgeon advised it is understood that as part of the Shade Tree Cottages plat, <br />located immediately to the west of Rum River Meadows, that the new Potassium Street would be <br />constructed. It has also been verbally agreed that the City would pay for 50% of the cost of <br />securing the necessary fight-of-way and construction of Potassium Street that will serve both <br />Shadetree Cottages and Rum River Estates. The developers of these two subdivisions will pay <br />for the remaining 50% of these costs. As the final plans for Shadetree Cottages and Potassium <br />Street have not been approved as of yet, any approval that the Council would want to consider <br />for Rum River Meadows would need to be contingent on the construction of Potassium Street. <br /> <br />Community Development Director Trudgeon advised the final plat and site plan show a total of <br />23 detached townhomes in the same number and locations as indicated on the preliminary plat. <br />Overall the submitted final plat is consistent with the approved preliminary plat. Staff is <br />continuing to review the street, utility, grading, and drainage plan and may have future <br />comments as indicated in the Staff Review Letter. As indicated in the Staff Review letter, the <br />applicant must receive approval from the Lower Rum River Water Management Organization <br />(WMO) regarding the wetland sequencing and mitigation plan. Mr. Trudgeon reviewed that as <br />part of the preliminary plat discussions, the Council passed a motion for staff to begin <br />negotiation with the property owners to the north for the City to receive a "right of first refusal" <br />on the future sale of their land in order for the City to potentially create a second ingress/egress <br />to Rum River Meadows. Staff has identified several parcels located in the River Pines <br />subdivision that could serve as a future second access to and from the Rum River Meadows <br />subdivision and will soon be contacting the identified property owners. The City Council <br />adopted findings of fact supporting the rezoning of the parcel to Planned Unit Development. The <br />Rum River Meadows PUD will allow for the 3.3 net density as shown on the plat as well as the <br />following deviations from City Code: 1) A lesser structure setback between units (15 feet <br />instead of the required 20 feet), and 2) the use of detached townhome units as part of the <br />development. <br /> <br />Community Development Director Trudgeon advised staff is recommending approval of the <br />final plat subject to the following: <br /> <br />1) Compliance with City Staff Review Letter dated May 19,2006 <br />2) The City and the Developer entering into a Development Agreement <br /> City Council / May 23, 2006 <br /> Page 4 of 20 <br /> <br /> <br />
