Councilmember Hendriksen recommended that language be added that would require the fee title <br />owner to request a land use change. <br />Principal Planner Trudgeon inquired if Mr. Hendriksen was recommending that the landowner <br />sign the application. <br />Councilmember Hendriksen replied yes, explaining that he did not want to see developers <br />speculating and making a change that a property owner is not aware of. <br />Councilmember Anderson noted that there are instances where the City changes a land use <br />because it is in the best interest of the City and the property owner would not be required to make <br />the request. <br />Principal Planner Trudgeon explained that if the City Council were to make a land use change that <br />would be handled as a comprehensive plan amendment and that process would not change. What <br />Councilmember Hendriksen was recommending would pertain to rezoning requests. <br />Councilmember Anderson replied that the rezoning would follow the comprehensive plan <br />amendment process and she wanted to make sure that people understand that the property owner <br />may or may not agree with a land use change, but the change may still occur. She did not feel <br />that they should be giving property owners the impression that if they are opposed to a land use <br />change that it can't go forward. <br />Councilmember Hendriksen stated that there could be three scenarios. One would be where the <br />land owner requests a zoning change, the second being if the Council were to initiate a zoning <br />change, and thirdly a situation where third party, who is neither the Council or the property <br />owner, initiates the zoning change. He felt that the landowner has the right to request the change <br />as well as the Council, but he did not think that a third party has the right to come in and request <br />the change and initiate the procedure without ownership interest. <br />Mayor Gamec stated that a lot of times a developer will not purchase the property if the rezoning <br />is not approved, but felt that there should be place for the property owner to sign the zoning <br />application so that the City is assured that the property owner is aware of the request. <br />Commissioner Sweet expressed concern over who would be responsible for signing as the <br />property owner. She questioned whether all owners of the property would be required to sign the <br />application, noting that there could be an issue in divorce situations etc. <br />Mayor Gamec replied that the main concern is that the City knows that both parties agree with the <br />request. <br />Commissioner Sweet noted that she was referring to the instance of when more than one person <br />owns a piece of property. <br />Chapter 9 Committee/January 31, 2002 <br />Page 3 of 11 <br />
