Chairperson Nixt noted that the requirement of a traffic generation analysis was included as part <br />of site plan review and questioned if there was a definition of what would be required as part of <br />that analysis. <br />Mr. Gordon noted that he did not want City Code to be limiting as to what a traffic analysis <br />would require and felt it would be very difficult to come up with a definition that would satisfy <br />every event. <br />Chairperson Nixt stated that he would agree that it would be best to leave it undefined with that <br />added language "determined necessary by the City". <br />Councilmember Hendriksen felt that there should be some minimum standards included as part of <br />City Code. <br />Councilmember Anderson replied that the wording "as determined by the City" allows for the <br />appropriate discretion. <br />Councilmember Hendriksen stated that without the definition a developer could state that a two - <br />bedroom townhome unit only produces a certain amount of traffic. <br />Mr. Gordon noted that he would bring back language pertaining to the traffic generation analysis <br />for consideration. Mr. Gordon recommended adding a #15 on page 9-46 of City Code to be a <br />"catch-all" phrase that would include other studies that may be required. <br />Consensus of the Chapter 9 Committee was to add the "catch-all" phrase as #15 on page 9-46. <br />The Chapter 9 Committee discussed contract rezoning and recommended that language be <br />brought forward for consideration. <br />Consensus of the Chapter 9 Committee was to make the following language change to the last <br />paragraph of Subd. 3 Development Contract: "The contract shall also provide that it enures to <br />the benefit of and is binding on all heirs, assigns, and successors of the applicant. A copy of the <br />contract shall be kept on file as part of the permanent record of the site." <br />Councilmember Hendriksen stated that it appeared that staff recommending the deletion of the <br />administrative appeals process and the history behind that was that the Council was originally the <br />Board of Adjustment and then that responsibility was turned over to the Planning Commission. <br />Some time ago the Board of Adjustment made some decisions that were arbitrary and there was <br />nothing that permitted the applicant from appealing to the Council so a section was added to <br />allow for such an appeal to the City Council. <br />Mr. Gordon explained that the administrative appeals process has to do with a situation where <br />someone has stated that staff is in error and they are stating that the Council is the appropriate <br />body to handle the staff complaints. <br />Chapter 9 Committee/January 31, 2002 <br />Page 9 of 11 <br />
